Powers Conducts Healthcare Reform Interest Groups Survey
  • May 21, 2010

Did you know that the Patient Protection and Affordable Care Act requires the issuance of at least 41 new sets of regulations?  Government agencies have already issued several regulations and other guidance to implement the health care reform legislation.  Notably, new rules have been issued addressing: provider enrollment and documentation related to orders of certain services and supplies, high risk pools for individuals with pre-existing conditions and federal subsidies for health plans for early retirees.  In addition, the Secretary has already named a Director of CMS’s new Center for Medicare and Medicaid Innovation, which soon will be considering funding proposals submitted by providers and others who keep themselves apprised of the opportunities presented by the health reform legislation.

On March 22, Powers Pyles Sutter & Verville Principal Peter W. Thomas was invited by the White House to attend the ceremony following the signing of the Patient Protection and Affordable Care Act.  Mr. Thomas represented the Consortium for Citizens with Disabilities or CCD in his role as Co-Chair of the Health Task Force, and was honored to be seated in the third row of the 400-person event held at the U.S. Department of the Interior. Federal Trade Commission Delays Enforcement of Red Flags Rule until June 1, 2010
  • March 4, 2010

In November 2007, the Federal Trade Commission issued a set of regulations known as the “Red Flags Rule” or the Rule requiring that certain entities develop and implement written identity theft prevention and detection programs to protect consumers from identity theft. Due to wide confusion over who must comply with the Rule, the FTC has postponed enforcement of the Rule four separate times, with the most recent postponement issued November 1, 2009. In order to give entities more time to review FTC guidance and develop and implement mandated written identity theft prevention programs, the FTC has further delayed enforcement of the Rule until June 1, 2010.
