Powers 340B attorneys William von Oehsen, Barbara Williams and Shuchi Parikh presented on a range of topics at the 340B Coalition Summer Conference in July, including preparation for HRSA audits, when and how to self-report and to take corrective action, understanding Medicare cost reports and application of Medicaid billing and reimbursement policies to 340B drugs.

The three-day conference consists of educational programs focused on all aspects of the federal 340B drug discount program. Session topics included legislative activity affecting the 340B community, developments regarding Medicaid billing and reimbursement, advocacy and communications, contract pharmacy management and more.

Powers 340B Attorneys at 340B Coalition Conference

Principal William von Oehsen presented at and served as the moderator for the Tuesday session “Navigating HRSA Audits and Taking Corrective Action.” The session examined what covered entities should do if a compliance problem is detected by HRSA or by the organization through an internal self-audit. Speakers also elaborated on corrective actions to take to resolve these findings.

Bill has been involved with the 340B Program for more than 25 years. He played a key role in helping to enact the program in 1992 and to expand the law in 2010 under the Affordable Care Act. In 1997, he helped organize the 340B Coalition, which now represents a dozen national organizations whose members comprise virtually all of the safety net providers participating in the 340B program.

Principal Barbara Williams spoke Monday during the 340B Career Development Workshop. Her session, “Understanding Medicare Cost Reporting,” was an interactive forum that guided attendees through the key elements in Medicare Cost Reports.

Barbara advises clients on compliance with the requirements of the 340B program and on preparing for, and responding to, 340B audits. Barbara also focuses on Medicare and Medicaid reimbursement issues, both in advising clients on meeting regulatory requirements and with representing clients before the Provider Reimbursement Review Board.

Associate Shuchi Parikh presented at the “Medicaid Billing and Reimbursement” session on Tuesday. This session explored developments at the intersection of the 340B and Medicaid programs, including California Medicaid’s mandatory carve-out proposal; state trends regarding billing, reimbursement, and different strategies that can be used to engage states on 340B issues.

Shuchi has experience counseling 340B covered entities, including hospitals, federally qualified health centers, Ryan White Clinics, and others, on a variety of 340B-related matters. Shuchi also advises 340B covered entities on contracting matters involving the 340B program.
