Rosie Dawn Griffin is a Principal in Powers Pyles Sutter & Verville’s healthcare and litigation practices.

Rosie represents community health centers, other healthcare entities, and recipients of federal funding in trial and appellate courts nationwide. An experienced litigator, Rosie’s national practice focuses on health care reimbursement, health center immunity under the Public Health Service Act, fraud and false claims, and federal grants. She has litigated and won precedent-setting cases in multiple federal appellate courts and defends providers and others facing government investigations and enforcement actions.

Rosie leverages her litigation mindset and years of experience in federal courts and before administrative agencies to help clients navigate the complex requirements attached to federal funding. She brings a particularly deep knowledge of the federal False Claims Act (FCA) and advises on risk mitigation strategies, internal investigations, responses to subpoenas and civil investigative demands, and both voluntary and mandatory disclosures.

Rosie has:

  • Succeeded on appeal to the Ninth Circuit in case against a state Medicaid agency for violation of FQHC Medicaid payment rights.
  • Succeeded on appeal in matters of first impression in the Second and Ninth Circuits involving government’s erroneous denial of Federal Tort Claims Act (FTCA) immunity for FQHCs and their employees.
  • Obtained FTCA immunity on behalf of FQHCs and FQHC providers in federal district courts within the Second, Fourth, Ninth, and Eleventh Circuits.
  • Secured the promulgation of a long overdue 340B administrative dispute resolution rule in a suit against the U.S. Department of Health and Human Services (HHS).
  • Obtained preliminary injunctive relief on behalf of federal grantee facing erroneous repayment obligation.
  • Successfully challenged grant terminations and significant cost disallowances before the HHS Departmental Appeals Board.
  • Defended FQHCs against Department of Justice FCA investigations.
  • Conducted internal investigations and guided federal grantees through the process of voluntary and mandatory disclosures.
  • Authored amicus brief on behalf the American Public Health Association, The Guttmacher Institute, The Center for U.S. Policy and 547 deans, department chairs, leading academic scholars and public health professionals in reproductive rights matter before the United States Supreme Court.
  • Served a two-year Department of Justice (DOJ) Honors Program clerkship in the Executive Office for Immigration Review.
