Principal Barbara Straub Williams was recently quoted in the Law360 article, “340B Appellate Cases to Watch in the 2nd Half Of 2026,” providing comments on the high-profile federal appeals that could shape the future of state 340B contract pharmacy laws.
The article examines several closely watched appellate cases across the country, including matters pending before the First, Fourth, Ninth, and Tenth Circuits, as courts continue to consider whether state laws restricting manufacturers’ contract pharmacy policies are preempted by federal law. These decisions could have significant implications for covered entities participating in the 340B Drug Pricing Program and may ultimately prompt review by the U.S. Supreme Court.
“These decisions will be very important because if there is a circuit split, the issue is more likely to be reviewed by the Supreme Court,” Barbara shared.
