On May 7th, the U.S. Department of Health and Human Services (HHS) Office for Civil Rights (OCR) released an Interim Final Rule on Section 504 of the Rehabilitation Act of 1973 (Section 504) that extends the compliance dates for web content and mobile apps accessibility by one year. The revised compliance dates are:
- May 11, 2027 for recipients with 15 or more employees
- May 10, 2028 for recipients with fewer than 15 employees
The Interim Final Rule does not include changes to any other compliance dates or requirements in the Section 504 Final Rule from 2024.
OCR requested comments on all aspects of the Interim Final Rule, including any economic, environmental, or federalism effects. Comments must be submitted on or before July 6, 2026.
In addition, OCR noted that it will consider issuing a Notice of Proposed Rulemaking (NPRM) to allow members of the public with an opportunity to comment on the substance of the 2024 Final Rule and any changes OCR proposes, including changes to the web consent and mobile app accessibility requirements.
