Securities Enforcement

Today’s marketplace is an often-hostile environment for public companies and their directors and officers; therefore, selection of a defense team with proven experience and deep resources is critical. The Powers securities litigation law firm team has the capability to zealously and vigorously defend our clients’ interests.

We represent public companies, officers and directors, accounting firms, financial institutions, underwriters, and others in class actions and investigations and enforcement actions by the SEC, often achieving early dismissal of matters and significantly smaller settlement amounts. Most recently, our litigation law firm team successfully represented at trial two individual clients against whom charges of securities fraud or insider trading were alleged.

Civil and Administrative Litigation

Power's strengths in the realm of civil litigation result from our broad experience in all manner of cases resolved both within the courtroom and at the settlement table. Our practice includes representation of clients in administrative proceedings before state and federal agencies and other quasi-judicial tribunals, as well as before state and federal courts, appellate courts, and the U.S. Supreme Court.

The attorneys at Powers have represented clients in hundreds of administrative and judicial proceedings arising under federal laws, including the Social Security Act, the Administrative Procedure Act, the Freedom of Information and Privacy Acts, the False Claims Act, the Public Health Service Act, the Clean Air and Water Protection Acts, various Civil Rights statutes and constitutional provisions, as well as common law actions for fraud, misrepresentation, libel, and invasion of privacy. We also represent companies and individuals in employment discrimination cases, general commercial litigation, insider trading and securities litigation, and tax matters before the Internal Revenue Service and the Tax Division of the Department of Justice.
